How to declare my activity as an influencer?

With Skeepers, you are engaged in a commercial influencing activity. Therefore, you must declare your activity.

Indeed, you are considered to be conducting a commercial influencing activity under the law when you meet the following cumulative conditions:

  • You receive a gift in exchange for creating content.
  • You promote a product, service, or cause, either directly or indirectly.
  • You address the public through digital means.

For US influencers:

Taxable products

  • Products you received for free, whose merchant value is higher than 100$
  • Products you received for free if you received more than 600$ worth of products (per year) from the same company
  • Any products received for free beyond 18,000$ per year in 2024 (it will be 19,000$ in 2025)

Tips: you should track the products you receive all year round and their market value. Ideally, you should also seek the advice and support of an expert (accountant). If there is the slightest doubt, we recommend that you declare all products you received.

When collaborating with a brand, you are classified as an independent contractor.

At the end of the fiscal year, businesses may issue tax forms called 1099s to their independent contractors. This form outlines the exact amount of income the contractor earned from the company during the previous year.

Influencers working with multiple brands may receive a separate 1099 form from each one. However, companies are only obligated to send 1099s to contractors they’ve paid over $600 in a year.

It’s crucial for you to track all of your income throughout the year (including gifts).

If you earn less than $600 with each brand, you may not receive a 1099 form from those companies detailing your annual earnings. Ultimately, it is your responsibility to report all income as an independent contractor.

In case of doubt, it is always best to seek guidance from an expert. Keep track of the products you receive throughout the year, along with their market value and documentation showing the product's value.
